Welcome to AmericasMarket. These Terms of Service ("Terms") are a binding agreement between you and AmericasMarket ("we", "us", "our") covering your use of americasmarket.com and any related products, content, or services (collectively, the "Service"). By creating an account, purchasing an Exam Pass Kit, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What we are
AmericasMarket is a self-paced, mobile-first study tool for U.S. contractor licensing exams. We sell digital "Exam Pass Kits" containing practice questions, full-length practice exams, printable cheat sheets, and procedural guidance. We are an independent study product. We are not affiliated with, endorsed by, or sponsored by the California Contractors State License Board (CSLB), PSI Services LLC, or any state licensing authority.
2. Not legal, professional, or licensing advice
Everything we publish — questions, explanations, blog posts, cheat sheets, AI summaries — is provided for educational purposes only. It is not legal advice, accounting advice, code interpretation, or an official statement of any state's licensing requirements. Always verify current rules, codes, deadlines, and forms directly with the relevant state board (e.g., the CSLB) before making decisions about your license, your business, or a job.
3. Accounts
- You must provide a valid email address and create a password (or use the magic-link option) to access purchased content.
- You are responsible for keeping your credentials confidential and for everything that happens under your account.
- Accounts are for a single individual. You may not share your account, your sign-in link, or your purchased content with anyone else.
- You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
4. Purchases, pricing, and access
- Single Exam Pass Kits are sold for a one-time price of $499 and grant 1-year access to one contractor classification's study materials.
- The "All Licenses" bundle is sold for a one-time price of $899 and grants 1-year access to every classification we publish on AmericasMarket during the access window, including future classifications and additional state Law & Business exams as we roll them out.
- Prices, taxes, and product contents may change at any time. Changes do not affect access you have already purchased.
- All purchases are processed by Stripe. By checking out, you agree to Stripe's payment terms in addition to ours.
- "1-year access" runs from the date of purchase. We may extend an access window at our discretion — for example, after an outage.
5. Refunds — pass-or-free guarantee
We back the product with a pass-or-free guarantee: do all the prep in your Exam Pass Kit, sit the real CSLB exam for the classification you bought, and if you don't pass, submit your official PSI/CSLB result and we start your refund within 24 hours, no questions asked. Full eligibility and how to claim are in our Refund Policy. The free California Law & Business Exam Pass Kit carries no charge and nothing to refund.
6. License to use the Service
Subject to these Terms and any access window tied to your purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to access the Service for your own individual exam preparation. You may print cheat sheets and study materials for your own use, including on the job site.
You may NOT:
- Resell, sublicense, repost, mirror, or redistribute our content, including questions, explanations, cheat sheets, practice exams, and AI-generated study material.
- Scrape, crawl, or systematically harvest questions or other Service content, whether by script, browser automation, or LLM agent.
- Use the Service or any content from it to train, fine-tune, evaluate, or otherwise build a competing study product or AI model.
- Bypass any paywall, RLS rule, rate limit, or other access control on the Service.
- Use the Service to cheat on a real licensing exam, including by attempting to bring AmericasMarket content into a proctored testing center where doing so is prohibited.
7. AI-generated content
Parts of the question bank, study explanations, and FAQ content are generated or refined with help from large language models, then reviewed against published source materials and state blueprints. We work hard to keep content accurate, but AI-generated text can be wrong, out of date, or miss nuance. Treat everything as a study aid, not a substitute for primary sources — code books, state board notices, and PSI's official candidate handbooks.
8. Your content
If you submit feedback, corrections, sample questions, or other suggestions to us, you grant AmericasMarket a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate that feedback into the Service without obligation to you. We don't claim ownership of your underlying ideas — we just need the freedom to act on what you tell us.
9. Service availability and changes
We aim for high uptime but make no guarantees. We may add, change, remove, or rebuild features at any time. We may also retire individual questions, mocks, or classifications if the underlying state blueprint changes. None of that is a breach of these Terms.
10. Termination
You can stop using the Service at any time. You can to request deletion of your account. We may suspend or terminate access if you violate these Terms, abuse the Service, or attempt to harm other users — for example by sharing accounts, scraping questions, or chargebacking after using the product. We will not refund purchases tied to a terminated account if the termination is for cause.
11. Disclaimer of warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will help you pass any specific exam. Passing a licensing exam depends on many factors outside our control, including your study habits, prior experience, and the version of the exam you receive.
12. Limitation of liability
To the maximum extent permitted by law, AmericasMarket and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, business opportunity, or licensing outcome, arising out of or related to the Service — even if advised of the possibility. Our total aggregate liability for any claim related to the Service is capped at the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD $100.
13. Indemnification
You agree to defend, indemnify, and hold harmless AmericasMarket, its operators, and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction there. If you are a consumer in a jurisdiction whose law grants you stronger protections, those protections still apply.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above and, where appropriate, notify you in-product or by email. Continued use of the Service after a change means you accept the updated Terms.
